Terms and conditions

This is a translation of the Dutch terms and conditions. In case of any discrepancy, the Dutch version prevails.

General

These terms and conditions apply to the use of Race With Me (“the Platform”). By using the Platform, you agree to these terms.

If you do not agree, you must stop using the Platform immediately.

Race With Me offers two types of use, each with its own rights and obligations:

Organisers who purchase a package to offer the Platform to participants in their event.
Participants who use the Platform to be followed during a race, either free of charge through an organiser or on their own initiative through a subscription.

Nature of the service

Race With Me is an independent, external service and operates separately from the organisation of an event. An organiser may offer the Platform to participants, but the use of the app by an individual participant is always voluntary and on their own initiative. The agreement for the use of the Platform is concluded between you and Race With Me, not between you and the organiser of the event in which you participate. The organiser is not responsible for the operation of the Platform; Race With Me is not responsible for the organisation, execution or safety of the event itself.

Use of the Platform

You are responsible for all activities that take place through your account.
You must provide correct and up-to-date information.
The Platform may not be used in a way that disrupts its operation for other users, or that conflicts with these terms or the law.

Minors

The Platform may be used by minors, for example at youth or family events. A parent or legal guardian must accept these terms on behalf of a minor and is responsible for the child’s use of the Platform.

Organisers

Organisers can purchase a package (e.g. Starter, Pro or Business) that allows participants in their event to use the Platform free of charge during that event.
Prices, package contents and payment terms are stated on the Platform at the time of purchase and exclude VAT, unless stated otherwise.
Payment is made in advance via our payment processor. Access to the package’s features is granted only after payment has been received.
If the event is cancelled no later than two weeks before the scheduled date of the event, the organiser will be refunded the amount paid. In the event of cancellation within two weeks of the scheduled date, or after the event has started, no refund will be given.
The date of the event may be changed, provided the event has not yet taken place. In that case the package remains valid for the new date; this does not count as a cancellation and does not entitle the organiser to a refund.
A package gives participants access to the Platform; it does not give the organiser any additional access to personal data of individual participants other than as described in our privacy policy.

Participants

Participation in the Platform through an organiser is free of charge for the participant, provided the organiser has purchased a valid package for the event concerned.
Independently of any organiser, a participant can also take out their own subscription. With their own subscription, a participant can share races of their choice via the Platform, regardless of whether the organiser of that race has purchased the Platform.
A participant’s own subscription is entirely separate from any arrangements between Race With Me and an organiser, and can be taken out, changed or cancelled independently via the Platform.

Health and safety

Race With Me is not sports medical or safety advice.
Participation in running activities and the use of location features is at the participant’s own risk.
You are responsible for your own physical condition, safety and compliance with local laws (e.g. traffic rules) while using the Platform.
Any rules and safety regulations of an event organiser are outside the responsibility of Race With Me.

Location and content

The Platform uses location data to enable tracking features, as described in our privacy policy.
The accuracy and availability of location data cannot be guaranteed and depend on external factors such as GPS reception and network connection.
Users are responsible for the content and information they share, and for the setting of their profile (public or private).

Intellectual property

All intellectual property rights relating to the Platform are held by Race With Me or its licensors. It is not permitted to copy, modify or distribute the Platform or any part of it without prior written permission.

Availability

We strive for the highest possible availability of the Platform.
We do not guarantee that the Platform will always be available without errors or interruptions.
Maintenance or technical failures may cause temporary interruptions, including during an ongoing event.

Liability

Use of the Platform is at your own risk.
To the extent permitted by law, Race With Me is not liable for indirect damage, consequential damage, loss of data or loss of profit arising from the use of the Platform.
Nothing in these terms limits liability for damage resulting from intent or deliberate recklessness on the part of Race With Me, or to the extent that liability cannot be excluded or limited by law (for example in the case of certain forms of personal injury).
Race With Me is not responsible for the organisation, execution, safety or course of the event in which you participate via the Platform; this is the responsibility of the organiser.

External services

The Platform may use or refer to third-party services, including payment processors and timing/results providers. Race With Me is not responsible for the content, operation or privacy practices of these third parties.

Termination

We reserve the right to restrict or terminate accounts or packages in the event of misuse, breach of these terms or legal obligations.

Changes

We may amend these Terms and Conditions. By continuing to use the Platform after a change, you accept the amended terms.

Applicable law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands.

Additional terms for the Apple App Store

If you download the Race With Me application via the Apple App Store, the following additional terms apply:

The licence granted to you is limited to a non-transferable licence to use the application on Apple devices that you own or control, in accordance with the App Store usage rules.
This agreement is concluded between you and Race With Me, and not with Apple. Apple is not responsible for the application or its content.
Apple has no obligation whatsoever to provide maintenance or support services with respect to the application.
In the event that the application fails to conform to any applicable warranty, you may notify Apple. Apple may, where applicable, refund the purchase price of the application to you. To the maximum extent permitted by law, Apple has no other warranty or liability obligations with respect to the application.
Race With Me, and not Apple, is responsible for addressing any claims by users or third parties relating to the application, including but not limited to:
- product liability,
- failure to comply with applicable laws and regulations,
- claims under consumer protection or privacy legislation.
Race With Me is responsible for the investigation, defence, settlement and discharge of any claim that the application infringes third-party intellectual property rights.
You represent and warrant that you are not located in a country subject to a United States embargo and that you are not listed on any United States government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of this agreement. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary.
